Terms & Conditions Effective Date: January 9, 2026

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Jenkins Photo (“Company,” “we,” “our,” or “us”) governing your use of our website www.Jenkins-Photo.com (the “Site”) and photography services (collectively, the “Services”).
By accessing the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, you must refrain from using our Site or Services.

1. Services
We provide professional photography services, including but not limited to Senior Photography, family photography, wedding photography, maternity photography, and related deliverables. Specific service terms, deliverables, and fees are outlined in individual service agreements or contracts executed with each Client.

2. Bookings and Payments
A signed contract and non-refundable retainer are required to secure booking.
The remaining balance is due as set forth in the signed photography contract.
Failure to remit payment as required may result in cancellation of Services
All fees are non-refundable except as expressly provided in the Client’s contract.

3. Client Responsibilities
Clients are responsible for:
Providing accurate information at the time of booking.
Ensuring all participants arrive on time for scheduled sessions.
Obtaining necessary permits, approvals, or permissions for shoot locations (unless otherwise agreed).

4. Intellectual Property Rights

All photographs and digital files created by Jenkins Photo remain the exclusive intellectual property of the Company, protected under copyright law.
Clients are granted a limited, non-exclusive, non-transferable license for personal use of the images.
Images may not be altered, reproduced, or used for commercial purposes without prior written consent.

5. Cancellation and Rescheduling

Cancellations must be provided in writing. Retainers are non-refundable.
Rescheduling is subject to availability and may incur additional fees.
In cases of illness, emergencies, or inclement weather, we reserve the right to reschedule at no additional cost.

6. Limitation of Liability

To the maximum extent permitted by law:

Our liability for any claim arising out of Services is limited to the amount paid by the Client.
We are not responsible for failure to perform due to events beyond our reasonable control, including natural disasters, illness, accidents, equipment failure, or government restrictions.

7. Indemnification

You agree to indemnify and hold harmless Jenkins Photo, its officers, employees, and contractors from any claims, damages, or expenses arising from your use of our Services, violation of these Terms, or infringement of third-party rights.

8. Website Use

You agree not to misuse the Site, including engaging in unlawful activity, attempting to access restricted areas, or interfering with the functionality of the Site.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of laws principles.

Any dispute arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved, disputes shall be submitted to binding arbitration in [Insert County/State], pursuant to the rules of the American Arbitration Association. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
